Terms of Service

Welcome to VoiceGab. These Terms of Service ("Terms") govern your access to and use of the VoiceGab mobile application and related services (collectively, the "Service") provided by VoiceGab ("we," "our," or "us"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using VoiceGab, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and VoiceGab. We may offer additional features subject to supplemental terms, which will be presented to you before you use those features.

2. Eligibility

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction, which may be up to 16) to use VoiceGab. By using the Service, you represent and warrant that you meet this requirement and that you are not barred from using the Service under any applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the VoiceGab application on your personal device for personal, non-commercial use, subject to these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the Service
• Reverse engineer, decompile, or disassemble the application
• Use the Service to develop a competing product
• Remove, alter, or obscure any proprietary notices

4. Your Account

You are responsible for maintaining the security of your account and all activity that occurs under it. You agree to:

• Provide accurate account information
• Keep your authentication credentials secure
• Notify us immediately of any unauthorized access
• Not share your account with others

You may delete your account at any time from within the app. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. Subscriptions & Payments

VoiceGab is currently free to download and use. We may introduce optional paid subscriptions or in-app purchases ("Paid Features") in the future. If and when Paid Features are offered, the following terms apply:

• Billing: All purchases are processed by the app store through which you downloaded the app (Apple App Store or Google Play) using the payment method on file with that store. We do not collect or store your payment card details.
• Pricing: Prices, features, and billing periods will be clearly displayed before you purchase. Prices may vary by region and may include applicable taxes.
• Auto-renewal: Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the current period ends. You can manage and cancel subscriptions in your app store account settings; deleting the app does not cancel a subscription.
• Refunds: Refunds are handled by the applicable app store under its policies. Except where required by law, payments are non-refundable and no refunds or credits are given for partial billing periods.
• Changes: We may change subscription prices or features with reasonable advance notice. Price changes take effect at the start of the next billing period, and you may cancel before the change applies.
• Free trials: If a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled beforehand.

6. Prohibited Use

You agree not to use VoiceGab to:

• Send spam, unsolicited messages, or bulk communications
• Harass, threaten, bully, or intimidate other users
• Share content that is illegal, harmful, defamatory, or obscene
• Impersonate another person or entity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Distribute malware, viruses, or other harmful code
• Interfere with or disrupt the Service or its infrastructure
• Use automated bots, scrapers, or other tools to access the Service

We reserve the right to suspend or terminate accounts that violate these Terms.

7. User Content

You retain ownership of voice messages and content you create through VoiceGab ("User Content"). By using the Service, you grant us a limited, worldwide, royalty-free license to transmit, temporarily store, and (for public posts) display your User Content solely for the purpose of operating and providing the Service — delivering private messages to your intended recipients and making public posts visible to other users.

Because private voice messages are end-to-end encrypted, we cannot access or moderate their content. Public voice posts on the Voice Feed are visible to other users; we may remove public content that violates these Terms and may suspend accounts that post it. You are solely responsible for your User Content and represent that you have all rights necessary to share it and that it does not violate any law or the rights of any third party.

If you believe content on the Service infringes your copyright, contact us at legal@voicegab.com with sufficient detail for us to assess the claim.

8. Intellectual Property

VoiceGab, including its name, logo, design, code, and related materials, is owned by VoiceGab and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you rights to use our brand or intellectual property beyond what is necessary to use the Service.

If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.

9. Third-Party Services & App Stores

The Service relies on third-party services, including Firebase (Google) for authentication, notifications, and analytics. Your use of those services through VoiceGab may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

If you downloaded the app from the Apple App Store or Google Play, you acknowledge that these Terms are between you and VoiceGab only — not with Apple or Google. The app store provider has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to apps downloaded from the App Store, and may enforce them against you. You must also comply with the applicable app store's terms of service when using the app.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service. We will provide reasonable notice of discontinuation where practicable.

Upon termination, your license to use the app ends and your account data will be deleted in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination (including Sections 7, 8, and 11–17) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy or reliability of any content obtained through the Service. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOICEGAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service
• Any unauthorized access to or alteration of your transmissions or data
• Any third-party conduct on the Service
• Any other matter relating to the Service

Our total liability for any claims arising from or related to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless VoiceGab and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms; (b) your User Content; (c) your violation of any law or the rights of any third party; or (d) your misuse of the Service.

14. Dispute Resolution

Before filing a claim, you agree to first contact us at legal@voicegab.com and attempt to resolve the dispute informally. We will try to resolve the dispute within 60 days of receiving your notice. If we cannot resolve it informally, either party may pursue the dispute in accordance with Section 15.

To the extent permitted by law, each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Nothing in this section prevents you from bringing claims in small-claims court or from exercising non-waivable rights under the law of your country of residence.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware, and the parties consent to the personal jurisdiction of those courts. If you are a consumer in the EEA or UK, you additionally benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service before they take effect.

17. Miscellaneous

• Entire agreement: These Terms, together with the Privacy Policy and any supplemental terms, constitute the entire agreement between you and VoiceGab regarding the Service.
• Severability: If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
• No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Export compliance: You may not use the Service in violation of applicable export control or sanctions laws.
